Sean “Diddy” Combs has filed a notice to appeal his conviction and sentencing in his sex crimes trial. Earlier this month, the rapper was sentenced to 50 months in prison, a punishment his lawyers have claimed was biased against him.

A prison location has yet to be finalized, and Diddy is currently being held at the Metropolitan Detention Center in New York. He has also requested to serve his sentence at FCI Fort Dix in New Jersey.

The final decision on his placement will be made by the Bureau of Prisons in the coming days, based on several factors related to Sean “Diddy” Combs’ case.

The Rapper Has Filed A Notice of Appeal

On Monday, Diddy filed to appeal his conviction and sentencing on prostitution offenses that stem from his sex crimes trial, per TMZ.

The rapper was previously handed down a four-year and two-month sentence and other punishments on October 3 by Judge Arun Subramanian,  after he had hoped he would be released on time served.

Following the filing, the music mogul’s legal team is expected to submit its full appeal brief within four to six weeks.

The document will likely include, under the appropriate headings, key details of the case, including a concise summary of the facts relevant to the issues being reviewed.

Leading the appeal is attorney Alexandra A.E. Shapiro, as his counsel, one of the many lawyers who have represented Diddy amid his recent legal troubles.

Diddy Believes He Has A ‘Strong Basis’ To Appeal

The filing of the appeal comes as no surprise, as another of his attorneys, Marc Agnifilo, had indicated this plan to the press shortly after the sentencing.

“We are planning to appeal,” Agnifilo said at the time, per News Nation. “We think we have strong basis to appeal.”

During the interview, Agnifilo also seemed to suggest that Subramanian was biased against Diddy, who was found not guilty of the other serious offenses, like racketeering and sex trafficking, by the jury.

“What we feel happened today was that the judge acted as a 13th juror, one we did not choose, and that he second-guessed the jury’s verdict,” he added.

Diddy’s Lawyer Slammed The Judgement

Marc Agnifilo initially hit out at the judgment passed on Diddy in a chat with the New York Post days after the sentencing.

The lawyer slammed the decision as a “legal error,” claiming that the embattled music mogul’s conduct and mixed verdict did not warrant such a harsh punishment.

“Both the guidelines calculation and the sentence took account of conduct for which Mr. Combs was acquitted by a jury,” Agnifilo said.

He added, “We contend this amounts to legal error.”

The Rapper Is Yet To Be Assigned A Prison

For now, Diddy remains at the Metropolitan Detention Center in New York, the facility he has been detained in since his arrest last September.

He is expected to move to a federal prison in the coming days, where he will serve the rest of his sentence.

Already, Diddy, via his lawyers, has indicated his preference for FCI Fort Dix, a low-security federal correctional institution in New Jersey.

That request was refused by Subramanian, despite the rapper noting in a letter that the facility was the best place for him to “address drug abuse issues” and “maximize family visitation and rehabilitative efforts.”

Instead, he recommended that Diddy pick a different geographic location and also recommended that the rapper be considered for admission to any available substance abuse program.

The final decision on where Diddy will serve time rests with the Bureau of Prisons, which typically considers factors like the severity of the offense, the required security level, and the inmate’s rehabilitation or programming needs.

All About Diddy’s  Strict Post-Prison Special Conditions

At the time of his sentencing, Diddy also received five years of supervised release and was ordered to pay a fine of $500,000.

It was later revealed that the music mogul will also have to follow strict special conditions after his jail term is done, per TMZ.

These include participating in outpatient treatment for both substance abuse and mental health issues, as well as continuing any prescribed medications unless otherwise directed by a healthcare professional.

He will also be required to complete a domestic violence intervention program, which seems to be a rehabilitative punishment for his viral 2016 hotel hallway assault involving ex-girlfriend Cassandra “Cassie” Ventura.

Finally, Diddy must comply with all search requests, avoid any contact with his victims, and is prohibited from owning a firearm or any other weapon capable of inflicting bodily harm.
